Privacy Policy for gofinance.cloud

I. General Provisions

This Privacy Policy outlines how the personal data of Users is collected, processed, and stored, which is necessary for providing electronic services via the gofinance.cloud website (hereinafter: the Service). The Service collects only the personal data that is essential for the provision and development of the services offered. Personal data collected through the Service is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (the General Data Protection Regulation, hereinafter GDPR), as well as the Act on the Protection of Personal Data of 10 May 2018.

II. Data Controller

III. Purpose of Collecting Personal Data

Personal data is used for the following purposes:

• account registration and verification of the User's identity,
• enabling login to the Service,
• fulfilling contracts related to services and e-services,
• promotion of the Controller's offer,
• marketing, remarketing, and affiliation,
• personalization of the Service for Users,
• analytical and statistical activities,
• establishing and pursuing claims or defending against them.

Providing data is voluntary, but it is necessary to conclude a contract or to use other functionalities of the Service.

IV. Types of Personal Data Processed

The Controller may process the User's personal data, such as: first and last name, and email address.

V. Period of Personal Data Processing

User personal data will be processed for the following periods:

• when the basis for data processing is the performance of a contract – until the statute of limitations for claims after its fulfillment,
• when the basis for data processing is consent – until it is withdrawn, and after its withdrawal until the statute of limitations for claims.

In both cases, the limitation period is 6 years, and for claims regarding periodic services and claims concerning the conduct of business activity – 3 years (unless a specific provision states otherwise).

VI. Disclosure of Personal Data

User personal data may be disclosed to: entities associated with the Controller, its subcontractors, entities cooperating with the Controller (e.g., companies handling e-payments, law firms). User personal data will be transferred outside the territory of the European Economic Area (EEA).

VII. User Rights

The User of the Service has the right to: access their personal data, rectify it, delete it, restrict its processing, transfer it, and object to its processing, as well as withdraw consent at any time (this will not affect the lawfulness of processing based on consent prior to its withdrawal). Requests to exercise these rights should be sent to contact@gofinance.cloud. The Controller will comply with or refuse the request without undue delay – in any event, within one month of receiving it. The User has the right to lodge a complaint with the President of the Personal Data Protection Office if they believe that the processing infringes on their rights and freedoms (GDPR).

VIII. localStorage Files

The Service collects information using the localStorage mechanism – both session-based and persistent. Collecting data via the localStorage mechanism supports the proper provision of services in the Service.

In contrast to cookies, localStorage:

• is not automatically sent to the server with every HTTP request,
• allows for storing a larger amount of data,
• does not require standard consent mechanisms, unless it stores data enabling the tracking of the user for marketing or profiling purposes.

IX. Automated Decision-Making and Profiling

User data cannot be processed in an automated manner such that any decisions affecting them are based solely on that processing. User data may be subject to profiling for the purpose of tailoring content and personalizing the offer, provided that the User has given their consent.

X. Final Provisions

The Controller reserves the right to make changes to this Privacy Policy, without limiting the rights of the Users. Information about any changes will be provided in the form of a notice available on the Service. In matters not regulated by this Privacy Policy, the provisions of the GDPR and Polish law shall apply.
